Is Severance Pay Mandatory in Spain?

Yes, severance pay is legally required in Spain for most types of employee dismissals. Under Spain’s Workers’ Statute (Estatuto de los Trabajadores), employees are entitled to severance when terminated for objective reasons or unfairly dismissed. The rate depends on the reason for termination: 20 days’ salary per year of service (up to 12 months) for objective dismissals, and 33 days per year (up to 24 months) for unfair dismissals.

Which Employees Qualify for Severance Pay?
